Core expectation

Use the tools responsibly and respect others’ rights

1) Acceptance

By accessing or using AssessBetter websites, subdomains, and UI tools (the “Services”), you agree to these Terms of Service (“Terms”). If you don’t agree, don’t use the Services.

2) Who we are

AssessBetter (“we,” “us,” “our”) operates assessbetter.com and related subdomains.

3) Changes

We may update these Terms. The “Last updated” date shows the current version. If changes are material, we’ll post a notice on the site.

4) Privacy

Your use is also governed by our Privacy Policy. We only collect personal information when you provide it (e.g., blog subscription), and we use operational/performance analytics to run and improve the Services.

5) Accounts & Communications (if applicable)

If you create an account or subscribe to the blog, you must:

  • Provide accurate information.
  • Keep credentials secure.
  • Feel free to unsubscribe from emails at any time.

6) Acceptable Use

You agree not to:

  • Violate laws or third-party rights.
  • Attempt to disrupt, overload, or reverse-engineer the Services.
  • Upload or input malicious code.
  • Misrepresent your identity or affiliation.

Sensitive data: Our public tools are not designed to assist processes that require FERPA-protected or other sensitive personal information. Do not submit such data. You are responsible for what you input.

7) Your Content; License to Us

You retain ownership of content you submit. You grant us a non-exclusive license to host, process, and display that content solely to operate, secure, and improve the Services (including running AI inference and quality assurance). You represent you have rights to submit the content.

8) AI/LLM Notice (Important)

The Services integrate large language models (LLMs). Outputs may contain errors or omissions. Always verify results. The Services are human-in-the-loop tools and do not replace professional judgment, accreditation decisions, or compliance obligations.

9) Third-Party Services

We use third-party providers (e.g., hosting, DNS/CDN, analytics, AI model APIs). They process data on our behalf to operate the Services. We are not responsible for third-party sites linked from the Services.

10) Intellectual Property

The Services (including software, design, and content we provide) are owned by us or our licensors and are protected by IP laws. Except for the limited rights granted in these Terms, no license is granted.

11) Feedback

If you send suggestions or ideas, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.

12) Beta / Experimental Features

Some features may be labeled alpha, beta, or experimental and may change or be discontinued at any time. They are provided as-is.

13) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ACCURACY, RELIABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.

15) Indemnification

You will indemnify and hold us harmless from claims arising out of your content, your use of the Services in violation of these Terms, or your violation of laws or third-party rights.

16) Termination

You may stop using the Services at any time. We may suspend or terminate access for any violation of these Terms or to protect the Services, with or without notice. Upon termination, Sections 7, 10–15, and 17 survive.

17) Governing Law

These Terms are governed by the laws of the State of Idaho, excluding conflict-of-law rules. Courts located within Idaho shall have exclusive jurisdiction.

18) Export & Compliance

You agree to comply with applicable export, sanctions, and compliance laws.

19) Entire Agreement

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services and supersede prior agreements on this subject.
